Heard learned counsel for the parties.

This application for regular bail arises out of Rajoun P.S. Case No. 512 of 2019 (S.T. No.117 of 2020), registered for the offence punishable under Section 392 of the Indian Penal Code.

The petitioners' prayer for regular bail was earlier rejected by an order dated 07.01.2021 passed in Criminal Miscellaneous No.19932 of 2020.

Learned counsel for the petitioners has submitted that the petitioners are in custody since 23.12.2019 and in

Patna High Court CR. MISC. No.43831 of 2021(4) dt.22-09-2021 2/2 similar circumstance co-accused Md. Nazir Ansari @ Bullet Ansari has been allowed regular bail by an order dated 25.08.2021 passed in Criminal Miscellaneous No.40845 of 2021, which has been brought on record by way of Annexure-3 to the supplementary affidavit filed on behalf of the petitioners. Considering the submission that in similar circumstance co-accused Md. Nazir Ansari @ Bullet Ansari has been allowed regular bail by this Court, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge, III, Banka, in Sessions Trial No.117 of 2020, arising out of Rajoun P.S. Case No. 512 of 2019.

This is subject to the condition that the petitioners shall present themselves before the Police / Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bond shall be liable to be cancelled.
