JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 386 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, this petitioner along with one other co-accused were demanded extortion money from the trick driver and both of them were apprehended on the spot by the police and from their possession fire arms were recovered. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because of his criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioner. None of the truck drivers from whom extortion

Patna High Court CR. MISC. No.43486 of 2021(4) dt.18-01-2022 2/2 money had been given to accused persons, has come forward to make accusation against the petitioner. He is in custody since 2.1.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Udwantnagar Police Station Case No. 492 of 2020.
