The petitioner seeks regular bail in Durgawati P.S. Case No. 114/2010 registered under Section 396 of the Indian Penal Code.
The petitioner is not named in the F.I.R.
Learned counsel for the petitioner submits that the name of the petitioner figured in the case in the confessional statement of co-accused Rambali Mushar, but nothing has been recovered from the possession of the petitioner. The looted mobile is said to have been recovered from the possession of Ramesh Kumar Yadav and Vikash Kumar Yadav and Vikash Kumar Yadav is said to have disclosed that he had purchased the mobile from the petitioner.
