The petitioners apprehend their arrest in a case registered for the offence under Sections 120(B), 420, 464, 468, 171(G) and 34 of the Indian Penal Code.

As per the prosecution case, these petitioners in collusion with other co-accused persons made forged election papers and declared Prabhunath Singh (petitioner no. 3), as

Patna High Court CR. MISC. No.34891 of 2022(2) dt.01-11-2022 2/3 Chairman and Shobha Devi (petitioner no. 1), as Secretary of the School Education Committee and thereafter, defalcated the government money.

It is submitted on behalf of petitioners that the alleged occurrence took place in the year 2004, but the complaint was lodged after lapse of more than two years, that too at the instance of other teachers and local criminals to pressurize the petitioners. Petitioner no. 1 is Secretary of the Committee, petitioner no. 2 is teacher, petitioner no. 3 is Chairman of the Committee and petitioner no. 4 is also Secretary of the Committee. Petitioner no. 1, 2 & 3 have got clean antecedent, whereas, petitioner no. 4 has got one criminal antecedent. Considering the delayed lodging of complaint case and the fact that petitioner no. 1 to 3 have got clean antecedent, the prayer for anticipatory bail of petitioners is allowed.

Let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Parsa P.S. Case No.
