JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This application has been filed for modification of order dated 8.3.2019 passed in Cr. Misc. No.2098 of 2019 with condition that the petitioner shall surrender within a period of six weeks and on surrender he will be released on provisional bail by the court below for a period of three months on the condition that the petitioner will pay back the total amount in three equal installments, first of which shall be deposited on his surrender and rest of the amount shall be deposited in two equal installments, within a period of three months, failure to deposit any of the installments, his bail bond shall be cancelled. Once the total amount is deposited, his bail bond shall be confirmed by the court below.

Submission of the learned counsel for the petitioner

Patna High Court CR. MISC. No.40557 of 2019(2) dt.04-07-2019 2/2 is that though he has deposited two installments but he could not surrender and now he is ready to deposit the remaining amount also and as such he has prayed for modification of the order as above.

In view of the above facts and circumstances as stated above, I am not inclined to interfere with the order passed earlier, however, if the petitioner surrenders and submits the proof of deposit of two installments paid , he will be grnated provisional bail for a period of two months and during that period he will deposit rest of the amount also.
