2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8, 20(b)(ii) (B) and 29 of the NDPS Act.

3. The case of the prosecution is that altogether 995 gm. of smack was recovered from a place where the accused persons were sitting.

4. Learned counsel for the petitioner submits that nothing has been recovered from the possession of this petitioner. It is further submitted by the learned counsel that one of the co-accused Kavita Rai has been granted by the learned Co-ordinate Bench vide Cr. Misc. Case No. 12368 of 2025. It has also been submitted that recovery has been made from a

Patna High Court CR. MISC. No.32282 of 2025(2) dt.21-05-2025 2/2 secluded place. No recovery was made from the possession of this petitioner. The case of this petitioner stands on similar footing. The petitioner is a man of clean antecedent and he is in judicial custody since 28.10.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bidupur P.S. Case No. 682 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal District and Sessions Judge, Vaishali at Hajipur.
