2. The petitioner seeks bail in a case registered for the offence punishable under Sections 191(2), 191(3), 109, 329(4), 352, 351(2), 126(2) of the B.N.S. and Section 25(1-B)a, 26/35 of the Arms Act.

3. The allegation made in the First Information Report is that the petitioner and six other accused persons had come to the house of the informant and were hurling abuses. It is alleged that at around 12 in the night when the informant saw from his window, the co-accused Manish Kumar fired at him which did not hit him. There is further allegation that all the persons were pushing on the door of the informant and hurling abuses.

4. Learned counsel for the petitioner submits that upon a perusal of the First Information Report, it would be apparent that as many as 12 persons have been made accused in the present case

Patna High Court CR. MISC. No.32539 of 2025(2) dt.20-05-2025 2/2 with general and omnibus allegations of hurling abuses and coming to the house of the informant variously armed. So far as the allegation of opening fire is concerned, the same is specific against one Manish Kumar however, the shot did not hurt any one in the family. It has further been pointed out that the said Manish Kumar has already been granted bail vide order dated 12.05.2025 passed in Cr. Misc. No. 12121 of 2025 taking into consideration the fact that the matter relates to property dispute and the present petitioner too is the brother-in-law of the informant. The petitioner is in custody since 06.03.2025 and bears one criminal antecedent which has been instituted by the same informant and he is on bail in the said case.

5. Learned APP for the State has opposed the application for anticipatory bail.

Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kurha P.S.
