The petitioner seeks bail in a case registered for the offences punishable under sections 395 and 397 of the Indian Penal Code.

Petitioner is not named in the first information report but from perusal of the impugned order it would appear that the name of the petitioner came in this case in the statement of the witnesses, who claimed to know about the name of the petitioner and other dacoits on the basis of conversations among the dacoits. However, it appears that except the aforesaid material as well as some criminal antecedent against the petitioner, there is nothing against him. Petitioner is in jail since 30.09.2015 but uptill now he

Patna High Court Cr.Misc. No.8243 of 2016 (2) dt.25-02-2016 has not been put on T.I. parade.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri M.
