JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Beldour P.S. Case No. 132 of 2014 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is named in the FIR and there is allegation against two accused persons, including the petitioner is of firing on the deceased and causing his death.
Submission of learned counsel for the petitioner is that after investigation police submitted final form against the petitioner and one Pramod Yadav and submitted charge sheet against some other accused persons. However, cognizance has been taken on protest petition. It is also submitted that materials collected during investigation do not support the prosecution allegation of firing against the petitioner. No.33537 of 2019(4) dt.13-09-2019 2/2 that co-accused Pramod Yadav has already been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 23.7.2019 passed in Cr.Misc.No. 18880 of 2019. Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Beldour P.S. Case No. 132 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the trial and appear in court as and when required.
