JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-12-2020 Heard Mr. Pramod Kumar Verma, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Mahila P.S. Case No. 26 of 2020 dated 25.07.2020 instituted for the offences under Sections 376 (A) (B) of the Indian Penal Code and Section 4 of the POCSO Act.
The petitioner is said to have committed rape on the prosecutrix.
Though, it has been stated in the bail petition that the petitioner is about 75 years of age and is in custody since 26.07.2020 but no evidence with respect to his age has been furnished with the bail petition.
Patna High Court CR. MISC. No.33457 of 2020(2) dt.15-12-2020 2/2 The prayer for bail of the petitioner, therefore, is rejected for the present.
However, if there is no substantial progress in the trial within a period of nine months from today, the petitioner would be at liberty to approach this Court again for grant of bail.
