2. Petitioner apprehends arrest in registered for the offences punishable under Sections 379, 411, 414 of the Indian Penal Code.

3. As per prosecution case, petitioner is alleged to have stolen the motorcycle of the informant.

4. Learned counsel for the petitioner submits that petitioner has been made accused on the basis of confessional statement of co-accused who was apprehended on the spot. No stolen article has been recovered from the conscious possession of the petitioner.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that from perusal of the impugned order dated 02.05.2023 passed by learned Additional Sessions Judge-XV,

Patna High Court CR. MISC. No.34846 of 2023(3) dt.28-07-2023 2/2 Sitamarhi, it is clear that petitioner has got one criminal antecedent.
