04.02.2015 Heard learned counsel for the petitioner and Mr. Rama Kant Sharma, learned senior counsel for the Vigilance.

The petitioner seeks provisional bail in Special Case No. 25 of 2014 arising out of Vigilance P.S. Case No. 13 of dated 12.02.2014 instituted under Sections 7/8/13(2)/13(1)(d) of the Prevention of Corruption Act. The prayer for regular bail of the petitioner was earlier rejected on 27.08.2014 in Cr. Misc. No. 14304 of 2014 and subsequently before the Supreme Court also, the matter was dismissed as withdrawn.

Learned counsel for the petitioner submits that they are two brothers and two sisters and the younger sister namely Shakuntala Kumari is to be married on 15.02.2015 and as the elder brother is 64 years, he be granted

Patna High Court Cr.Misc. No.3123 of 2015 (2) dt.04-02-2015 2/2 provisional bail.

Learned counsel for the Vigilance submits that as the petition is for provisional bail on the ground of marriage of his sister, the Court may take appropriate view in the matter.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on provisional bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Vigilance Judge, A.D.J., II Patna in Special Case No. 25 of 2014 arising out of Vigilance P.S. Case No. 13 of 2014. The petitioner shall surrender before the Court below latest by 2nd March, 2015 and an affidavit shall be filed in the present case annexing copy of the surrender certificate latest by 4th March, 2015. If such an affidavit is not filed by 4th March, 2015, the office shall place the case before the Bench for appropriate orders.

The application stands disposed off.
