The petitioner seeks bail in Baheri P.S. Case No. 52 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that 109.650 litres of foreign liquor has been recovered from Tempo. It is further alleged in the written report that out of two persons, one managed to run away from the Tempo and petitioner was caught hold from the Tempo. He disclosed the name of person fled away as Pappu Yadav who was driver of the Tempo. Counsel for the petitioner submits that petitioner was merely passenger in the aforesaid Tempo. He is in custody since 21.3.2019 having clean antecedent.
Patna High Court CR. MISC. No.31413 of 2019(2) dt.10-05-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge Vth cum Special Judge (Excise Act), Darbhanga, in connection with Baheri P.S. Case No. 52 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
