The petitioner has prayed for bail in a case instituted for the offence under Sections 302/34 of the Indian Penal Code. Prosecution story relates to abuse and assault to the informant's sister by her co-villagers including the petitioners as a result of which she succumbed to the injuries. The alleged occurrence took place when the deceased went to the house of the accused Manjhala Hembram for money and grain over which hot discussion arise.

Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.34462 of 2022(3) dt.13-02-2023 2/2 has submitted that petitioners are innocent and have been falsely implicated in this case. No specific overt act is attributed to the petitioners. General and omnibus allegation has been levelled against them. They are languishing in judicial custody since 16.03.2022.

Learned APP appearing for the State has opposed the prayer of Bail.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia in connection with K. Nagar (Maranga) P.S. Case No. 139 of 2022.
