JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 07.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Raniganj P.S. Case no. 359 of 2019, registered under Sections 302 and 201/34 of the Indian Penal Code. Learned counsel for the petitioners submits that it would appear from the F.I.R. that Raniganj P.S. Case No. 359

Patna High Court CR. MISC. No.33453 of 2020(2) dt.16-03-2021 2/2 of 2019 was instituted on 08.10.2019, under Sections 302 and 201/34 of the Indian Penal Code against 14 accused persons named in the F.I.R. and 20-25 unknown and at that time, petitioners were not named in the F.I.R. In course of investigation, after 35 days of the occurrence, it has come that in video clip, the face of petitioners were also identified, who were present there. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria in connection with Raniganj P.S. Case no. 359 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
