JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Siswan P.S. Case No. 48 of 2015 registered under Section 302/34 of the Indian Penal Code.

The accusation is that informant along with four others named in the F.I.R. armed with deadly weapon surrounded to Pappu Yadav, nephew of the informant. At that time, this petitioner caught hold color of Pappu Yadav, whereas Krishna Yadav gave knife blow at his left thigh.

Learned counsel for the petitioner submits that there is specific allegation against co-accused, Krishna Yadav, to give knife blow at the left thigh of Pappu Yadav with allegation against

Patna High Court Cr.Misc. No.9112 of 2016 (2) dt.28-03-2016 the petitioner is to caught hold the color of Pappu Yadav. It is further submitted that petitioner has no criminal antecedent and is in custody since 19.05.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Siwan, in connection with Siswan P.S. Case No. 48 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
