====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has antecedent of two cases and the informant alleges that on orders of Kamlesh, accused Chandan assaulted by brick causing injury on head, thereafter, petitioner assaulted by butt of gun causing injury and also assaulted by brick, thereafter Dharmendra assaulted by lathi, it is further alleged that the occurrence took place on account of previous dispute.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that there is specific allegation of assaulting the informant by brick on head by Chandan causing grievous injury whereas the
Patna High Court CR. MISC. No.34392 of 2022(2) dt.28-11-2022 2/2 allegation against the petitioner is of assaulting by butt of gun but then the F.I.R does not disclose. It is also submitted that petitioner will not abscond or evade the law but will cooperate in the investigation and will present himself as and when called by the Investigating Officer so that truth comes out. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nalanda P.S. Case No. 95 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
One of the bailors shall be Vikash Kumar, cousin brother, of the petitioner.
