JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-06-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of writ in the nature of mandamus or any other appropriate writ for direction to the respondents to remove the encroachment made on Khata No. 486 Plot No. 618 area 1.60 decimal which is Gair Majarua Aam (Rasta) particularly encroachment made by private Respondent No. 8 and 9.

Patna High Court CWJC No.10706 of 2017(2) dt.26-06-2023 2/2 (ii). For issuance of writ in the nature of Mandamus or any other appropriate direction to the respondents to comply the order passed in Makhdumpur Encroachment Case No. 968 of 2013-14 dated 15.9.2014 in its letter to spirit."

At the outset, the learned counsel for the RespondentState has referred to the counter affidavit, filed by the District Magistrate, Jehanabad, to submit that there is no encroachment over the land, appertaining to Khata No. 486, Plot No. 618, Area 1.60 decimal and the aam rasta is also unfettered as also free from any encumbrance, as is apparent from the photographs annexed to the said affidavit, filed by the District Magistrate, Jehanabad.

In view of the aforesaid, the learned counsel for the petitioner submits that in case, the petitioner is having any subsisting grievances, he be granted liberty to approach the District Magistrate, Jehanabad for redressal of the same. Liberty, so sought, is granted.
