The petitioner seeks bail in connection with Trial No.7260 of 2014 arising out of Mufassil Motihari P.S. Case No.29 of 2012 registered for the offence punishable sections 392 of Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court on 21st January, 2014 in Cr. Misc. No.2820 of 2014 with following observation:- "However, if the trial is not concluded within seven months from the date of receipt/production of a copy of this order, the petitioner would be at liberty to renew his prayer for bail."

It has been contended that though the petitioner is in

Patna High Court Cr.Misc. No.5837 of 2015 (2) dt.18-02-2015 2/2 custody since 2nd August, 2013 but till date no witness has been examined.

Regard being had to the observation made in the aforesaid order dated 21st January, 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar Motihari, East Champaran in connection with Trial No.7260 of 2014 arising out of Mufassil Motihari P.S.
