The petitioner seeks bail in Bisfi P.S. Case No. 142 of 2009, instituted for the offence under Section(s) 328, 307, 379 and 120B/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. During investigation, the name of petitioner has been disclosed by co-accused Md. Mokim and Arjun Rai in their confessional statement. He further submits that other co-accused have already been granted bail by coordinate Benches of this Court vide orders dated 10.1.2011 and 11.4.2019 passed in Cr. Misc. 23484 of 2010 and 20332 of

Patna High Court CR. MISC. No.31427 of 2019(2) dt.10-05-2019 2/2 2019 respectively.

Petitioner is in custody since 15.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bennipatti, Distt. Madhubani, in connection with Bisfi P.S. Case No. 142 of 2009, subject to the condition that both the bailors will be the close relatives of the petitioner.
