2. The petitioner seeks regular bail in connection with Roh P.S. Case No. 91 of 2024 lodged on 19.03.2024 under Section 341/323/307/354/379/427/504/506/34 of the Indian Penal Code.

3. As per the prosecution case, F.I.R. has been lodged against seven named accused persons including the present petitioner against whom there is an allegation of assaulting the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the criminal antecedent of the petitioner is clean and the petitioner is in custody since 20.03.2024. Counsel submits that the petitioner's bail application was rejected by the Trial Court with observation that petitioner may renew his

Patna High Court CR. MISC. No.38607 of 2024(2) dt.27-05-2024 2/2 prayer for bail after filing of charge-sheet but instead of waiting, he had come before this Court. Counsel further submits on merit that petitioner and the informant are adjacent neighbour and belongs to same village and on pity land dispute, scuffling took place between the informant and the petitioner, case and counter case has been lodged against each other from both the sides i.e. Roh P.S. Case No. 91 of 2024 and Roh P.S. Case No. 92 of 2024.

5. Learned APP for the State opposes the prayer for bail and submits that opinion on the injury is still reserved

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of J.M.-1 Class, Nawada in connection with Roh P.S. Case No. 91 of 2024 subject to the condition laid down under Section 437(3) of the Cr.P.C.
