JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-04-2021 As prayed for, through video conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 16.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.
Heard the parties through video conferencing. The petitioner seeks pre-arrest bail in connection with Rani Talab P.S. Case No. 57 of 2020, registered under Sections 147, 149, 323 and 307 of the Indian Penal Code and 25(1-b)a, 26 and 27 of the Arms Act.
In course of the patrolling duty information was received about making fire between two groups in village Gona, then, informant, along with other police personnel reached at village Gona where firing was being made in which from one side Krishna Murari Sharma and Saroj Singh and from other
Patna High Court CR. MISC. No.35662 of 2020(2) dt.16-04-2021 2/3 side Vikas Kumar and Ramanuj Singh (petitioner) were engaged in firing. In between the house of two groups there was a Shiv Temple, from behind the temple Krishna Murari Sharma and Saroj Singh whereas from the front side of the temple Vikas Kumar and Ramanuj Singh (petitioner) were making fire. On seeing the police party both sides fled away from there with their arms. But, on search, behind temple, three empty cartridges of 8MM and in front of the temple two empty cartridges were recovered.
Submission is that petitioner has no criminal antecedent and he has falsely been implicated in this case. Further, submission is that while in the search and seizure list, annexed with the first information report, it appears that from the house of Krishna Murari Sharma one double barrel gun with six live cartridges were recovered, but, regarding that there is no description.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Rani Talab P.S. Case No. 57 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the
