JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 18.10.2014 in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code. It is alleged that the informant's husband was working in Ice Factory but he went missing from 16.10.2014. Subsequently, his dead body was recovered. Suspicion was raised against the petitioner since one Guddu Goswami wanted to get registered the joint family land through father in law of the informant and this petitioner was an associate of Guddu Goswami It is submitted by the learned counsel for the petitioner that from the impugned order which has been recorded after going
Patna High Court Cr.Misc. No.3843 of 2015 (2) dt.30-01-2015 2/2 through the case diary, it appears that no direct evidence has been collected during investigation against the petitioner and on circumstantial evidence accusation of conspiracy has been alleged. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhagalpur in connection with Nath Nagar(Madhusudanpur) P.S.
