The petitioner seeks bail in connection with Tariyani P.S. Case No.189 of 2014 registered for the offences punishable under sections 302 read with 34 and 120B of the Indian Penal Code.
It has been contended that though the petitioner is named in the FIR but the informant of the case is not an eye witness of the alleged killing of one Nanhak Rai. In course of investigation also apart from suspicion, there is no other material to connect the petitioner with the alleged occurrence.
Learned counsel for the State has opposed the prayer for
Patna High Court Cr.Misc. No.3501 of 2015 (3) dt.04-03-2015 2/2 bail. He has submitted that the case is of circumstantial evidence and there was strong motive for killing the deceased. Be that as it may, having regard to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sheohar in connection with Tariyani P.S. Case No.189 of 2014.
