JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Gogri P.S. Case No. 361 of 2018, disclosing offences under Sections 341, 323, 379, 188, 504, 506, 34 of IPC and Section 27 of the Arms Act.
Prosecution case is that accused persons were trying to grab the land of the informant, for which, a proceeding under Section 144 of Cr.P.C. was initiated and the same was converted into a proceeding under Section 145 of Cr.P.C. and order for maintaining status quo was passed but the accused persons made construction over the same land, which was stopped by the informant, due to that petitioners and other accused persons abused the informant and assaulted him by fists and slaps and they have also snatched golden chain.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P.S.
