Petitioner is languishing in custody since 28.10.2013 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Accusation is of committing dacoity in the house of the informant.

It is submitted by the learned counsel for the petitioner that the name of the petitioner has been sprang up on the confessional statement of the co-accused. Neither there is any recovery from the possession of the petitioner nor he has been put on T.I.P.

Considering the fact that neither any recovery has been made from the possession of the petitioner and nor put on T.I.P., let the above named petitioner, be released on bail on

Patna High Court Cr.Misc. No.4238 of 2015 (2) dt.02-02-2015 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Ladaniya P.S. Case No. 03 of 2013.

Since the petitioner is accused in six other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
