Petitioner is languishing in custody since 04.02.2014 in a case registered for the offences punishable under Sections 307, 379/511,504, 323, 324, 341 of the Indian Penal Code.

It is alleged that petitioner tried to take away the belongings of Nagendra Pandey and Jawahar Pandey while they were descending from the train. It is further stated that Nagendra Pandey caught hold the petitioner and in the meantime the petitioner inflicted knife blow to him, when the informant and Jawahar Pandey tried to save Nagendra Pandey, they were also caused injuries.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.3576 of 2015 (2) dt.28-01-2015 petitioner that the injury has been found to be superficial and simple in nature and petitioner was accused in other case i.e. Shivsagar P.S. Case No. 99 of 1996. Considering the aforesaid facts and period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ah-hoc Additional District Judge-III, Rohtas at Sasaram in connection with Rail Sasaram P.S. Case No. 07 of 2014. Considering the criminal antecedent of the petitioner, the learned court below will cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
