JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-05-2016 The petitioner wants to renew the prayer of bail in connection with Sessions Trial No. 441 of 2012 arising out of Warishnagar P. S. Case No. 283 of 2011 pending in the Court of leanred Adhoc Additional District Judge, 1st, Samastipur which was earlier twice rejected by order dated 27.05.2014 and 14.10.2015 in Criminal Misc. No. 17316 of 2014 and 45635 of 2015 on the ground that the petitioner is in custody since 18.07.2012. The trial has not been concluded as yet and in near future the same is not likely to be concluded. The learned APP seriously opposes the prayer of bail by submitting that the petitioner is the main assailant and he is also an accused in Warishnagar P.S. Case No.283 of 2011 for offences punishable under Section 302/34 of the Indian Penal
Patna High Court Cr.Misc. No.19648 of 2016 (2) dt.11-05-2016 2/2 Code.
In the facts and circumstances stated above, at present finding no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected. Again the learned trial court is directed to take all positive steps to conclude the trial as early as possible considering the detention of the petitioner preferably within 6 months.
