Petitioner apprehends her arrest in a case registered for the offence punishable under Section 420/468/34 of the Indian Penal Code.

As per complaint petition, this petitioner by committing forgery got prepared Jamabandi showing her sole heir of the property and sold the joint ancestral land and got registered her name in Jamabandi register.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The dispute is of civil nature and no criminal offence is

Patna High Court CR. MISC. No.43273 of 2021(5) dt.22-08-2022 2/2 made out. It is further submitted that Title Partition Suit No. 308 of 2016 is pending between the parties and just to put pressure the complainant has filed this case with frivolous allegation. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Begusarai in connection with Complaint case No.1221C/ 2019, subject to conditions laid down u/s 438(2) of the Cr.
