The petitioner is languishing in custody since 11.11.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 3(2) (v) of SC/ST (Prevention of Atrocities) Act.
It is alleged that due to the negligent surgery performed by this petitioner the wife of the informant died. It is submitted by learned counsel for the petitioner that there is nothing on the record to suggest that due to the petitioner's fault the victim died. The informant retracted from the initial version and filed a petition to that effect before the learned court below and the compounder Sangita Devi has been
Patna High Court Cr.Misc. No.4103 of 2015 (02) dt.30-01-2015 2/2 granted bail vide Cr. Misc. No. 44917 of 2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhojpur at Ara in connection with Agion (Garahani) P.S. Case No. 77 of 2014.
