Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.09.2015 in a case registered under Section 307 and other minor sections of the Indian Penal Code and Sections 25( 1-B) A, 26, 27, 35 of the Arms Act.

Petitioner and one co-accused Roshan Kumar Pandey were caught on the spot and firearms were recovered from their conscious possession but according to the prosecution case itself, firearm injuries were caused to the informant by other accused

Patna High Court Cr.Misc. No.8651 of 2016 (2) dt.01-03-2016 2/2 persons and one co-accused, namely, Chhotu Rai, having more or less similar allegation, has already been granted privilege of bail by a co-ordinate Bench of this court.

No doubt, petitioner carries criminal antecedent but taking note of the aforesaid facts as well as submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagha, West Champaran in connection with Chautarwa P.S.Case No. 264 of 2015.
