Petitioner is not named in the first information report but it appears that the learned court below has committed error in the impugned order mentioning the petitioner as named accused. Moreover, there is counter case which has been lodged by the petitioner against the prosecution party of the present case and it is pointed out on behalf of the petitioner that F.I.R. named accused have already been granted privilege of anticipatory bail by a coordinate Bench of this Court.
