The petitioner is languishing in custody since 14.09.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The accusation is of making assault by all the FIR named accused persons to the father of the informant. The petitioner was not named in the FIR. His name transpired during investigation.

It is submitted by learned counsel for the petitioner that since the informant side are accused in Basantpur P.S. Case No. 258 of 2013 as the father of this petitioner was killed at the hands of the informant side, hence, the petitioner has

Patna High Court Cr.Misc. No.3822 of 2015 (02) dt.29-01-2015 2/2 been roped in the present case.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S.
