The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act and subsequently Section 25(1-b)a, 26/35 of the Arms Act was added.
It has been submitted on behalf of the petitioner that he is innocent, committed no offence and only on the basis of suspicion he has been arrested by the police. He further submits that similarly situated co-accused have been granted the privilege of bail by coordinate Benches of this Court in Cr. Misc. No. 24739 of 2019 and Cr. Misc. No. 44406 of 2019 vide order dated 10.07.2019 and 19.07.2019 respectively. Considering the fact that from the possession of the
Patna High Court CR. MISC. No.32310 of 2019(3) dt.28-08-2019 2/2 petitioner one country made pistol and two live cartridges were recovered, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Sigori P.S. Case No. 03 of 2019 pending before the learned Additional Chief Judicial Magistrate-V, Danapur. Accordingly, the application is dismissed. However, the trial court is directed to conclude the trial within one year. (Anjani Kumar Sharan, J) devendra/- U T
