Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 307, 353, 34 of the Indian Penal Code and Sections25(1-AA), 25 (1-a), 25(1-b)a, 26, 27, 35 of the Arms Act. The prosecution case in short is that on the basis of confidential information, the informant with police personnel conducted a raid in the forest on the bank of the river. It is alleged that as soon as the informant reached there, the notorious criminals started firing on police force. Counter firing was made and some criminals were arrested and recovery of arms were also made.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.32251 of 2019(2) dt.16-05-2019 2/2 petitioner. The petitioner is in custody since 24-11-2018. Charge sheet has already been submitted. One masket along with 8 live cartridges is said to have been recovered. The other co-accused with similar allegation has been granted bail by coordinate benches of this court vide order dated 19-04-2019 passed in Cr. Misc. No. 25217 of 2019. There is no compliance of Section 100 of the Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 334 of 2018.
