2. Petitioner seeks regular bail in connection with Vidyapati Nagar P.S. Case No. 166 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per prosecution case, 3943.35 litres foreign liquor was recovered from a truck.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor
Patna High Court CR. MISC. No.33632 of 2025(2) dt.18-07-2025 2/2 driver of the seized truck. Petitioner is in custody since 24.03.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application of the petitioner and submits that petitioner has got four criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-I, Samastipur in connection with Vidyapati Nagar P.S. Case No. 166 of 2024.
