JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 20-02-2018 The present writ petition has been filed for quashing the order dated 20.06.2002 as contained in Annexure-3 passed by the Sub Divisional Officer, Bettiah, Sadar whereunder he has cancelled the agreement entered into for Public Distribution System of the petitioner and others; and for connected reliefs.

2. At the very outset learned counsel for the petitioner accepts that for same cause of action CWJC No. 32279 of 2006 had been filed which was however dismissed for default on 13.12.2011. MJC No. 489 of 2012 was filed for its restoration which was however allowed by order dated 20.06.2012. Again the writ petition was dismissed for default on 21.09.2012 and yet another restoration petition has been filed vide MJC No. 5475 of 2012 and the same stood dismissed by order dated 31.10.2012.

3. Instead of seeking remedy against such dismissal, the instant writ petition has been filed which cannot however be entertained for the same
