Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The case is registered under Section 304(B) and 34 of the Indian Penal Code in connection with Sikraul P.S. Case No.19/2022. As per the prosecution story, the informant has alleged that his daughter was married to Laddu Gope but was tortured for Rs.10,000/- and on the fateful day, 17.02.2022, he got information that she has been killed.

Learned counsel for the petitioner submits that he is an old man, living separately from the couple, the husband is in jail and he is in custody from the very next day i.e. 18.02.2022. His last submission is that the deceased's husband is in custody. Taking into account the fact that the petitioner is father-inlaw, he is custody since 18.02.2022, charge sheet stands submitted

Patna High Court CR. MISC. No.34385 of 2022(2) dt.12-09-2022 2/2 and the husband is in custody, this Court is inclined to grant him privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Sikraul P.S. Case No.19/2022 to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to following conditions:

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail by the Trial court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
