The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

280 liters of country-made liquor has been recovered from a Bolero Ambulance and one co-accused Rakesh Rai, who was apprehended on the alleged vehicle, disclosed the name of petitioner, as the person, who fled away from the spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the vehicle in question and has got clean antecedent.

Considering the nature of allegation and clean

Case No. 449 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
