The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 457, 323, 380, 384, 307 and 504/34 of the Indian Penal Code.
It is alleged that the land of the informant was being transferred in favour of petitioner no. 2 and other persons fraudulently.
It is submitted by the learned counsel for the petitioners that the issue has been settled between the parties and informant has filed a petition to that effect before the learned court below.
Considering the aforesaid facts, this Court is not
Patna High Court Cr.Misc. No.4654 of 2015 (2) dt.04-02-2015 inclined to grant anticipatory bail to the petitioner no. 2 because he is accused in N.D.P.S. Case No. 69 of 2007. So far as petitioner no. 1 is concerned, she has no criminal antecedent, let the above named petitioner no. 1 be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Motihari in connection with Muffasil P.S. Case No. 210 of 2010, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
