JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-08-2022 Though the present writ petition has been filed for quashing the notice dated 27.05.2017, issued by the Circle Officer, Sultanganj, District-Bhagalpur, whereby and whereunder the petitioners have been directed to remove encroachment from the land appertaining to Khata no. 42, Plot no. 762, Area 6 decimal situated at village Taraita, PSSultanganj, District-Bhagalpur, however, it is submitted that the respondents have filed a counter affidavit, wherein it has been stated that after hearing the petitioners, orders have been passed to remove the encroachment in question, hence it is submitted that liberty be granted to the petitioners to file appropriate appeal challenging the final order passed by the Circle Officer,

Patna High Court CWJC No.15119 of 2017(3) dt.02-08-2022 2/2 Sultanganj, District-Bhagalpur i.e. the respondent no. 3. Liberty so sought, is granted.

It is needless to state that if appropriate appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits and pass appropriate orders, in accordance with law, expeditiously.

The present writ petition stands disposed off on the aforesaid terms.
