A supplementary affidavit has been filed on behalf of the petitioner in the Court. Let it be kept on record. 3.

The present application has been filed for modification of order dated 09.04.2024 passed in Cr. Misc. No.73459 of 2023 to the extent of modifying the condition whereby the petitioner was directed to return the amount of Rs.45,000/- to the informant and also for extending the period of surrender. 4.

Learned counsel for the petitioner submits that the petitioner wanted to return the amount of Rs.45,000/- to the informant but the informant is not ready to accept the same. As such, the petitioner be given permission to deposit the said amount in

Patna High Court CR. MISC. No.39739 of 2024(2) dt.26-07-2024 2/2 the Nazarat of Civil Court, Gaya, so that petitioner can furnish his bail bond.

Considering the same, the order dated 09.04.2024 passed in Cr. Misc. No.73459/2023 is modified to the extent that the petitioner is granted permission to deposit the aforesaid amount in the Nazarat of Civil Court, Gaya and after verifying the said deposit, his bail bond shall be accepted.

Further, the period of surrender is extended by six weeks from the date of receipt/production of a copy of this order in connection with Kotwali P.S. Case No.770 of 2022, pending in the court of learned Chief Judicial Magistrate, Gaya. 7.

The order dated 09.04.2024 passed in Cr. Misc. No.73459 of 2023 is modified to the extent as indicated above. 8.
