The petitioner is in custody since 08.11.2015 in connection with Atri P.S. Case No. 203 of 2015 registered for the offences punishable under 379 and 414 of the Indian Penal Code. Prosecution case in brief is that on 07.11.2015 at about 05:00 p.m. when the informant was sitting in his Cement Shop and his motorcycle was parked near his shop, he saw a thief taking his motorcycle. Subsequently, he raised alarm and with the help of pedestrian, he caught the accused near Shankar Hotel. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated by the informant due to ego clash. It is further alleged the petitioner is a

No.8831 of 2016 (2) dt.18-03-2016 2/2 tempo driver of the same locality and he dared to disobey the self proclaimed rule of no parking near his shop and that led the situation that informant challenged the petitioner that if he removes informant's motorcycle for making to place to park his Auto Rikshaw, then he will teach him lession and petitioner's daredevil to take the challenges of the informant led this false implication.

Considering the aforementioned facts and circumstances of the case as also that the petitioner has no criminal antecedent, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction Sri P.K.
