The petitioner is said to have given Farsa blow causing head injury to the informant. Annexure-2 to this petition shows that injuries found on the person of the injured were simple in nature said to be caused by hard and blunt substance. According to the prosecution case, the petitioner gave single blow and the injuries found on the person of the injured were simple in nature but even then learned Additional Sessions Judge-II, Saharsa, without applying his judicial mind, rejected the prayer for bail of the petitioner.

Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on

Patna High Court Cr.Misc. No.12793 of 2016 (2) dt.30-03-2016 2/2 furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. case No.337 of 2015.
