The petitioner is languishing in custody since 15.07.2014 in a case registered for the offences punishable under Sections 341, 323, 120B, 354A, 379, 504/34 of the Indian Penal Code and 3(1) (x) (xv) of SC/ST (Prevention of Atrocities) Act. It is alleged that when the sister and wife of the informant were uprooting the maize plants then the accused persons including the petitioner directed them not to work and consequently the accused persons assaulted the wife of the informant and they were torn the clothes of the wife of the informant.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.4646 of 2015 (02) dt.05-02-2015 2/2 petitioner that the accusation of assault to the wife and sister of the informant is against all the accused persons but no substantial injury has been caused and in the background of land dispute the accusation has been levelled.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj SC/ST P.S. Case No. 27 of 2014.
