The petitioner seeks bail in Akilpur P.S. Case No. 34 of 2014 registered under section 376/511 and other allied sections of the Indian Penal Code. Sabita Rai the victim made a statement that on 20.08.2014 at about 12 in the night while she was sleeping in her house, Mahendra Rai entered into her room and made an attempt to commit rape. He also snatched her chain made of gold.
Learned counsel for the petitioner submits that occurrence is alleged to have taken place on 20.08.2014 but the informant lodged the case on 17.09.2014 and no explanation is offered for such inordinate delay. It is further submitted that the petitioner has filed informatory petition on 02.09.2014 stating
Patna High Court Cr.Misc. No.3999 of 2015 (2) dt.29-01-2015 2/2 there in that the husband of the victim wanted to close his shop. . Having considered the fact that the case is lodged after 27 days of the occurrence and prior to that petitioner had filed an informatory petition, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in Akilpur P.S. Case No.34 of 2014.
