The petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

The informant named nine persons and alleged that they having armed with different weapon came and assaulted the informant. When son mother, wife and cousin brother of the informant came to save him, (Ramesh Pandey) petitioner, Chhotey Pandey, Kanhaiya Yadav, Chandra Shekhar Pandey and jitendra Yadav came having armed with firearm and Kanhaiya Yadav is alleged to have fired which hit the sister of the informant. Petitioner is alleged to have fired which hit the wife, mother and brother of the informant.

Patna High Court Cr.Misc. No.4896 of 2015 (2) dt.05-02-2015 2/2 Learned counsel for the petitioner submits that the petitioner is informant of Sikraul P.S. Case No. 112 of 2014 and alleged that accused persons Radheshyam and others assaulted him and other and also opened fire. It is further submitted that the mother, wife and brother of the petitioner got simple injury caused by hard blunt substance. Petitioner is in jail since 09.12.2013. It appears that there is a case and counter case. Petitioner is alleged to have fired but injuries found on the person of wife, mother and brother of the informant are simple in nature. Considering the aforesaid facts and the circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Sikraul P.S. Case No. 113 of 2014 (Prabhat Kumar Jha, J) M.Rahman/- U T
