Patna High Court CWJC No.15424 of 2018(2) dt.23-03-2023 2/2 Respondent no. -01 has illegally without any pledging (qualify the technical bit) arbitrarily and illegally allotted to the respondent no. 4 and disqualify the petitioner on the wrong ground with knowingly that Petitioner suitable bidder qualify all the criteria as per requirement in the tender notice no 01/2017-18, but the tender/ Work order has been allotted to the Respondent on 04 illegally.

II. For quashing of the entire tender notice which is based on favoritism and nepotism whereby and where under the petitioner is the suitable bidder in this tender fulfilling all the requisite criteria, vide notice no 01/2017-18, but the authority concerned with bias manner disqualify the petitioner and allotted work order to the respondent no. 4, which is not leg in the eye of law.

III. For any other relief/ relief's for which the petitioner is entitled for."

In the absence of any interim order, 4th Respondent has already executed the work allotted to him. Therefore, the present petition does not survive for consideration. Accordingly, the present petition stands dismissed as it has become infructuous.
