JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 7 of the EC Act. As per prosecution case, on inspection by the informant, petitioner's PDS shop was found running without valid licence and the POS machine.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that petitioner's PDS shop bears Licence No. 425N/2020-21 which is valid till 30.8.2025. It is also submitted that the petitioner's shop has not been issued POS machine. Petitioner has got no criminal antecedent.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above
Patna High Court CR. MISC. No.36609 of 2022(2) dt.07-11-2022 2/2 be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Jhanjharpur, Madhubani in Rudrapur Police Station Case No. 77 of 2021/GR No.1128 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
