JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 Learned counsel appearing on behalf of the petitioner submits that the petitioner was although made party but he was not served copy of the writ petition and in the absence of his assistance the Court has passed the order dated 2.4.2018 in CWJC No. 7980 of 2016.

Considering the fact that the review petitioner was not heard, the Court deems it fit and proper to recall the order dated 2.4.2018 and to provide opportunity of hearing to the counsel appearing on behalf of the review petitioner in view of the law laid down by the Apex Court in the case of Shivdeo Singh Vs. State of Punjab, AIR 1963 SC 1909.

The order dated 2.4.2018 is, accordingly, recalled.
